Billing & Client Expectations in the Modern Age: It's Worth It to Work It Out (1.5 hours total CLE credit - 1 hour Ethics credit)

Recorded on October 10, 2019

On Demand NE CLE Available Until: 10/09/2021

Description: This is the on demand version of the live CLE that took place on 10/10/2019 at the NSBA Annual Meeting. $50 per attendee.

Let’s be honest: getting paid for our legal services is critically important, but there’s rarely CLE available that discusses billing structures and the ethics of “alternative fee structures” such as flat fee billing. Likewise and tied to billing is the evolution of the modern client, and their changing expectations of the structure of the attorney-client relationship. Seeing the need for a serious discussion with top-tier talent, the OBA has flown in a nationally recognized ethics speaker to discuss:

  • The general ethics of billing practices, including utilizing hourly and flat fee practices within our ethical obligations (Neb. Ct. R. § 3-501.5);
  • More progressive ways of structuring fees ethically, including subscription legal services, incentive payments, and payment plans;
  • The changing consumer landscape in law, including the upcoming generation of legal consumers now expecting different practices than the old school methods;
  • Meeting demands of tech-driven client base, including utilizing design thinking to create a customer experience that any of the audience members would want to have for their own legal counsel; and
  • Highlight some key lawyers on the forefront of change.

This seminar seeks to identify areas of improvement in lawyers’ everyday communication with potential and existing clients, with the ultimate goal of creating a better outcome for both clients and counsel.

Megan Zavieh is the author of “The Playbook: The California Bar Discipline System Practice Guide.” After graduating from law school at the University of California at Berkeley School of Law (Boalt Hall) in 1999 at age 21, Megan launched her career with a Federal Clerkship in New York. She followed that with employment at three New York area law firms where she honed her litigation and electronic case management skills. At Zavieh Law, she focuses her practice exclusively on attorney ethics, providing representation to attorneys facing disciplinary action and guidance on questions of legal ethics. Megan is admitted to practice in California, Georgia, New York and New Jersey, as well as in multiple federal courts and the U.S. Supreme Court.
